Terms & Conditions
The vacation rentals that we offer are the personal vacation homes of our homeowners. The homeowners have made them available to share with respectful and responsible groups that treat them the way they would their own homes. Please bear in mind that our homes are located in communities with many year-round residents. While our guests are on vacation, the residents are not. In order to maintain the quality of our homes and the pease and quiet of our neighborhoods, all occupants must adhere to the following terms and conditions. Please contact our message us in advance of booking to make sure the home you are inquiring about and our policies are compatible with your group and intended use.
- Identification & Use: The names and ages of all occupants and proposed use of the property must be provided. A government-issued identification and the credit card used at booking must be presented at check-in prior to checking into the property. All adult groups must be 25 years of age or older for rentals less than 30 days.
- Maximum Occupancy: Guests shall not exceed the number of adults and children and children published on the property listing. Additional daytime guests are limited to a maximum of 4 and must depart prior to 10:00 PM. House parties and/or gatherings are strictly prohibited and will result in immediate eviction with no refunds.
- Noise: The City of San Diego has a 24hr/day noise ordinance that La Jolla Vacation Rentals strictly enforces. Guest must keep the volume of voices and music to a reasonable level and bring conversations indoors after 10:00 PM and close windows and doors to keep any noise inside.

Payment Information
Payments can be made by:
- American Express, Visa, MasterCard or Discover (a valid ID and Selfie will be required) 4% Convenience Fee for all credit card transactions.
- Check payments mail directly to: La Jolla Vacation Rentals Ca., 5693 La Jolla Blvd., La Jolla, CA 92037.
- Bank or Wire Transfer ($16 fee for each wire transfer)
- When paying via Credit Card, all credit card payments will be verified with a government-issued photo ID and a Selfie.
We will then meet you at day of check-in to verify your government-issued photo id with the credit card and name on file for the reservation.
Occupancy
Guest understands and agrees that the PROPERTY shall be occupied by no more than the number of individuals (including children and infants) published for said PROPERTY. Additional daytime guests are limited to a maximum of 4 and must depart prior to 10:00 PM. Maximum occupancy is strictly enforced. House parties and/or gatherings are strictly prohibited and will result in immediate eviction with no refunds.
Noise
The City of San Diego has a 24hr/day noise ordinance that La Jolla Vacation Rentals CA strictly enforces. Guests must keep the volume of voices and music to a reasonable level and bring conversations indoors after 10:00 p.m. and close windows and doors to keep any noise inside.
No Neighbor Disturbances
When you book with La Jolla Vacation Rentals CA – the booking includes a ZERO TOLERANCE POLICY for noise disturbances, over occupancy or house parties. NOISE OR CONTRACT VIOLATIONS THAT CAUSE NEIGHBOR COMPLAINTS WILL RESULT IN IMMEDIATE EVICTION OF ALL OCCUPANTS WITH NO REFUNDS GIVEN.
Trash
All other garbage items should be bagged, tied closed and placed only in your vacation rentals trash bin or recycle bin. Please contact our office if the bins are full.
Parking
Please do not exceed the designated amount of parking provided on the property. Do Not block neighboring driveways or use other parking spots and maintain access for emergency vehicles at all times. Please also be aware of any street signs where you park. We will not be liable for tickets if illegally parked due to street sweeping or otherwise. Guest is advised that in many high density beach communities, parking is at a premium and garages and parking spaces can be smaller than normal. Guest is advised to ask for measurements if parking is needed. No refunds will be given if vehicles do not fit in the designated spaces. Please verify dimensions of spaces and vehicles.
Reservations & Deposits
All reservations require a payment to hold chosen dates which would include 1/2 of the Total Room Rent. If you choose to pay a Refundable Security Deposit in lieu of the Damage Insurance you will be required to pay the Refundable Deposit with your 1st payment. Your final payment will be due 14 days prior to check-in.
Cancellation Policies
Reservations for this property are non- refundable past 30 days, however, we do offer Trip Cancelation Protection that costs 10% of the Total Room Rent and allows you to cancel up to 1 week (7 days) prior to the check-in date. You may cancel for any reason up to 7 Days (1 Week) before check-in if you purchase this option waiver at the time of booking and we will refund funds held for reservation minus the cost of the waiver. Please note we do not offer this option for last minute bookings… Your booking must be 30 day’s out from day of check-in to be eligible for this offer and it must be purchased at time of booking.
We reserve the right to cancel your booking if any unforeseen circumstances arise or the Property becomes temporarily uninhabitable, but we agree to fully refund any monies paid in advance by Guest or will make every effort to relocate Guest to a similar property at the same rate or if the rate is higher will discount that rate.
Cancelation of booking at any time after Confirmation has been issued may result in forfeiture of deposit(s). You must cancel 30 Days prior to Check-In. Cancelation after the 30-day period prior to check-in may result in forfeiture of the entire rental amount. Refund of monies paid for rental and services will be made under the following circumstance: (1) If, on the day that the rental is scheduled to begin, the property is unfit for habitation and no equivalent substitute can be obtained, or the property is not reachable by the usual means of transportation, or access to the property by visitors has been prohibited by authorities – Management will refund Guest in full; All refunds, whether in whole or pro-rata, will be subject to the deduction equal to 15% of deposit(s) and/or total paid. To protect against cancelations caused by certain unforeseen events, such as illness, death, natural disasters, etc., we recommend that guests purchase trip cancelation and Interruption Protection Insurance to assure refund of deposits paid and reimbursement of other vacation payments. Such insurance is available through travel agents, auto clubs such as AAA, or online at http://www.rentalguardian.com.
Reservation Prices Do Not Include
Expenses and items not mentioned, including, but not limited to: transportation, tips for personal services, meals, insurance, telephone calls (some homes have telephones but are limited to calls in the U.S. and Canada only) and other items of a personal nature.
Responsibility
Tenant hereby assumes all risk of damage to any and all personal property of Landlord and Tenant, including household furniture, appliances and/or equipment, landscaping, flooring and goods during such use and occupancy. Tenant hereby assumes any and all risks associated with the foregoing and agrees to hold Landlord and Owner harmless from and indemnify Landlord and Owner against the same.
Use
It is agreed that the Premises shall be used only for residential purposes, and for no other purpose whatsoever. Tenant in his possession, use and occupancy of the Premises agrees to observe and comply with all restrictions, laws and ordinances affecting the Premises or occupancy thereof. Tenant further agrees that no use shall be made of the Premises, or acts done which will increase the existing rate of insurance upon the Premises, or will cause a cancellation of any insurance policy covering the Premises.
Smoking
No smoking is allowed at any of our homes. If smoking does occur on the premises, Guest may be evicted and is financially responsible for all damage caused by the smoking, including, but not limited to, stains, burns and the cost of odor remediation and removal and replacement of damaged property.
Events & Parties
Events are strictly prohibited in all our properties. Excessive noise or complaints by surrounding neighbors can result in immediate removal from the property.
Disturbances
Guest and their guests shall behave in a civilized manner and shall be good neighbors, respecting the rights of the surrounding neighbors, and shall not create noise or disturbances that interfere with the quiet enjoyment of their property. Outdoor noise, or noise carrying outside from inside the home should be kept to a minimum regardless of the hour and in compliance with the local Noise Ordinance.
Hold Harmless
Landlord/Owner does not assume any liability for loss, damage, or injury to persons or their personal property. Neither does Landlord/Owner accept liability for any inconvenience arising from any temporary defects or stoppage in supply of water, gas, and electricity, outside construction noises, or plumbing. Nor will Landlord/Owner accept liability for any loss or damage caused by weather conditions, natural disasters, acts of God, or other reasons beyond and Landlord’s/Owner’s control.
TV, Cable, Internet, Satellite
Services are provided as a convenience only, and are not integral to this agreement. No refund of rents shall be given for outages, content, lack of content, speed access problems, lack of knowledge of use, or personal preference with regard to service.
Air Conditioning & Heating
Most rentals are not equipped with air conditioning. If so equipped, and if not regulated otherwise, Guest agrees that Air Conditioning shall not be set below 72 degrees and heat shall not be set above 78 degrees, and that the fan setting shall be “Auto”. Doors and windows shall be closed when either heat or air conditioning is in operation. There are no refunds for lack of, or malfunctioning HVAC units.
Lost Items
Manager shall bear no responsibility for lost, stolen or abandoned items. Every reasonable effort will be made to contact the Guest for return. All shipping charges will be charged to the Guest. Manager shall not be held liable for condition of said items. Any items not claimed for longer than 30 days may be donated or sold.
Pets
Pets are prohibited unless otherwise noted on the listing. If an unauthorized pet is found on the premises, Guest may and or/pet may be evicted and Guest is responsible to remedy any and all pet damages and the cost of remediation, including pet allergen remediation, flea remediation and reimbursement to Manager for any refunds necessary to relocate or compensate for relocation of future guests until remediation is completed.
Additional Terms & Conditions
Tenant, for himself/herself, his/her heirs, assignors, executors, and administrators, fully releases and discharges Landlord/Owner from any and all claims, demands, and causes of action by reason of any injury or whatever nature which has or have occurred, or may occur to the undersigned, or any of his/her guests as a result of, or in connection with the occupancy of the premises and agrees to hold Landlord/Owner free and harmless of any claim or suit arising there from. In any action concerning the rights, duties or liabilities of the parties to this agreement, their principals, agents, successors or assignees the prevailing party shall be entitled to recover reasonable attorney fees and costs.
By state law, occupancy may not exceed what is posted for each home. Maximum occupancy includes infants and children.
You must be 25 years of age or older to book a property with us and must accompany the occupants during the entire stay reserved.
Noise ordinances are strictly enforced in all our properties. You must respect the surrounding neighbors and any loud noise after 10:00 pm. May necessitate law enforcement intervention which will terminate your contract and result in immediate removal from the property with no refund for any remaining nights still paid for.
No Kegs allowed.
No RV`s or Campers allowed on the premises.
You must notify La Jolla Vacation Rentals Ca immediately if any maintenance problems occur.
No prior notice is required for La Jolla Vacation Rentals Ca or its representatives to enter the property to make necessary repairs/inspection. La Jolla Vacation Rentals Ca. will make every effort to notify Lessee prior to entering the property.
You may not assign responsibility or sublet – you must be the intended occupant of the property during the entire stay.
Any dog left unattended during your stay in either the home or the yard, and is barking or creating any nuisance will terminate your contract and result in immediate removal from the property with no refunds given.
